Maternity leave in Montenegro
Unlike pregnancy leave, which is opened for the purpose of maintaining pregnancy, maternity leave begins at the earliest 28 days before the expected due date, as determined by the chosen doctor.
Maternity leave lasts until the child turns one year old.
1. PROCEDURE AND DOCUMENTATION
- The employed woman (mother) receives a certificate from her chosen doctor confirming the start of maternity leave.
- This certificate must be submitted to the employer.
- Based on the certificate, the employer has the right to submit a request for a refund of the salary compensation paid to the employee during her absence.
2. SALARY COMPENSATION REFUND
The amount of the refund depends on the mother’s length of continuous employment:
- 12 months or more – 100% of gross salary is refunded
- 6–12 months – 70% of gross salary is refunded
- 3–6 months – 50% of gross salary is refunded
- Up to 3 months – 30% of gross salary is refunded
NOTE:
- IF THE REQUEST IS SUBMITTED WITHIN 30 DAYS FROM THE START OF LEAVE, THE REFUND APPLIES FROM THAT DATE.
- IF THE REQUEST IS SUBMITTED LATER, THE REFUND APPLIES FROM THE DATE THE REQUEST WAS SUBMITTED.
3. REQUEST PROCESSING PROCEDURE
- Documentation is submitted online via the portal: https://porodiljsko.gov.me/app/login.html
- To register on the portal, an electronic signature token is required, which can be purchased at the Post Office or from the company Coreit.
- During maternity leave, the employer cannot terminate the employment contract with the employee.
MATERNITY LEAVE FOR FATHERS
The law also allows fathers to use maternity leave, but only after 70 days from the child’s birth.
In this case, the mother may return to work, and the father takes over childcare and uses the right to leave for child care. Although this possibility exists, most fathers are not sufficiently informed about it.
