What Do the Labour Law Amendments Bring?

The amendments to the Labour Law introduce new rules that affect hiring, employment contracts, and the way work is organized. Here are the key changes employers should know about.

 

ELECTRONIC COMMUNICATION

Employees must provide their email address to the employer and notify the employer of any change within 3 days.

Emails and documents sent by the employer by email have the same legal effect as paper documents.

Employers must also send employment contracts to employees electronically.

 

SALARY TRANSPARENCY

Employers must state the starting salary or salary range in a job advertisement or before hiring. Job titles must be gender-neutral.

 

BAN ON DISCRIMINATORY QUESTIONS

During recruitment, employers may not ask about a candidate’s private life or previous salary.

 

PROBATION PERIOD

A probation period can last up to one quarter of the contract duration, but no longer than 6 months.

For example, if a contract lasts 4 months, probation can last up to 1 month.

If an employee has already worked for the same employer in the same role and completed probation, a new probation period cannot be introduced.

 

REMOTE WORK

When work is performed outside the employer’s premises, the employer must provide the necessary conditions for work, including equipment and tools.

 

EMPLOYMENT CONTRACTS AND EMPLOYER OBLIGATIONS

Employers must provide employees with information about working conditions, rights and obligations, in writing or electronically.

Employment contracts must now include additional information, such as the employee’s email address and probation terms, where applicable.

Employers can't prohibit employees from discussing their pay.

 

An employee who has worked for at least 6 months may request an indefinite-term contract. If the employer refuses, they must provide a written explanation.

 

 

OVERTIME AND PAID LEAVE

Employees may refuse overtime if legal conditions are not met.

PARENTAL LEAVE

Upon Montenegro’s accession to the EU, parental leave will last 14 months in total and will be shared between both parents, with 60 days reserved and non-transferable.

 

EQUAL SALARY

Men and women must receive equal pay for the same work or work of equal value.

 

ADOPTIVE PARENTS

Adoptive parents of a child under 8 years old are entitled to one year of leave from the date of adoption.

 

TERMINATION OF EMPLOYMENT

Employment ends automatically when an employee reaches 67 years of age and has at least 15 years of service.
